General terms and conditions of sale

1 - Preamble

The commercial site www.AtelierStEustache.fr is operated by the company ATELIER ST EUSTACHE SASU with a capital of 1 000 €, having its head office at 5 rue de Nuits 69004 LYON and registered in the Lyon trade and companies register under the number RCS 830 242 368.

The general terms of sale detailed below apply to all orders placed with the company ATELIER ST EUSTACHE SAS for all items offered on the website www.AtelierStEustache.fr, unless otherwise agreed in writing.

The conditions of sale applicable to any transaction on the site www.AtelierStEustache.fr, are those mentioned on line on this site at the time of the placing of order by the customer. The customer acknowledges having read these conditions prior to ordering.
Consequently, the fact of placing an order on the site www.AtelierStEustache.fr, implies the full acceptance of these conditions of sale by the customer.

2 - Prices

2-1 - The prices are expressed in euros all taxes included except participation in the expenses of treatment and forwarding.

2-2 - In case of order towards a country other than metropolitan France, the purchaser is the importer of the products concerned. For all products shipped outside the European Union and French overseas departments and territories, customs duties, other local taxes, import duties or state taxes may be due. These rights and sums do not fall within the competence of the company ATELIER ST EUSTACHE SAS. They will be charged to the buyer and are your entire responsibility both in terms of declarations and payments to the authorities and competent bodies in your country.

2-3 - All orders are payable in Euros.

2-4 - ATELIER ST EUSTACHE SAS reserves the right to modify its prices at any time on its website www.AtelierStEustache.fr. The products are invoiced on the basis of the prices in force at the time of the recording of the orders subject to availability. The products remain the property of ATELIER ST EUSTACHE SAS until the complete payment of the price.

3 - Order and Validation

3-1 -The customers of the company ATELIER ST EUSTACHE SAS must be emancipated minor or have the legal majority and not be protected in the sense of the article 488 of the Civil code. The company ATELIER ST EUSTACHE SAS reserves the right to refuse an order if the customer in question has a payment default in his order history.

3-2 -The present conditions are available on the site www.AtelierStEustache.fr. On request of the customer, they can be sent by e-mail or post.

3-3 -When the customer clicks on the "Place my order" button after the order process, he/she declares that he/she accepts the order as well as the entirety of the present General Terms and Conditions of Sale fully and without reserve. The data recorded by ATELIER ST EUSTACHE SAS constitutes the proof of all the transactions made by ATELIER ST EUSTACHE SAS and its customers. The data recorded by the payment system constitute the proof of the financial transactions.

3-4 - The Customer is responsible for the accuracy and completeness of the information provided by him/her on his/her Customer account and on his/her order to ensure its proper processing. ATELIER ST EUSTACHE SAS cannot be held responsible for additional delivery times or costs. Any costs incurred by ATELIER ST EUSTACHE SAS as a result of errors in the information provided by the Customer will be charged to the Customer.

4 - Availability

Our offers of products are proposed within the limits of available stocks. In this context, indications on the availability of the products are provided to the customer at the time of the placing of the order. If the articles prove to be unavailable after the order, the company ATELIER ST EUSTACHE SAS will inform and will invite the customer to cancel or to modify his order

5 - Delivery

ATELIER ST EUSTACHE SAS delivers its Products in France and certain French overseas departments and territories, in all countries of the European Union and in the following countries: Hong Kong, Japan, South Korea, Canada, United States, Algeria, Morocco, Tunisia.

Products are shipped to the delivery address indicated by the Customer at the time of ordering. Delivery cannot be made to hotels or post office boxes. The delivery times indicated on the site are indicative times, corresponding to average processing and delivery times. In order for these times to be respected, the Customer must ensure that he/she has provided accurate and complete information concerning the delivery address (such as, in particular: street number, building number, staircase number, access codes, names and/or intercom numbers, etc.). If the delivery information is incorrect, Atelier St Eustache declines all responsibility in the event of non-delivery. 

In the event of a delay in delivery of more than 10 working days, if the product has not been shipped, the Customer may cancel the order by registered letter with acknowledgement of receipt and request a refund of the order.
If the item has been shipped before receiving the cancellation of the order due to a delay in delivery of more than 10 days, ATELIER ST EUSTACHE SAS will proceed to the reimbursement of the item and of the shipping and return costs, upon receipt of the item, complete, in its original condition and with all labels.

ATELIER ST EUSTACHE SAS undertakes to inform the Customer of the progress of his order.

In case of damaged packages (already opened, missing products...), the Customer undertakes to notify the carrier and ATELIER ST EUSTACHE SAS, by any means, of any reservations within 3 days of receiving the product.

ATELIER ST EUSTACHE SAS cannot be held responsible for the consequences due to a delay in delivery that is not its fault.

6 - Payment

The payment of the totality of the price is carried out with the order. It is made by credit card (Visa, MasterCard, Carte Bleue Nationale and international) and credit card (American Express)

ATELIER ST EUSTACHE SAS takes all necessary measures to ensure the security and confidentiality of data transmitted online.

7 - Return policy and after sales service

7-1 - In accordance with articles L 121-16 of the French Consumer Code, the customer has a cooling-off period of 15 days from delivery to return the item(s) ordered without incurring any penalties, with the exception of the return costs, which will remain at the customer's expense. Items must be returned in their original packaging, labelled, complete, new, unworn and unwashed.

For health reasons, we cannot resell a product that has been in contact with the foot. Any sock tried on cannot be returned.

    Items returned incomplete, damaged, deteriorated or stained by the customer will not be refunded.

    The risks and costs of return are always at the customer's expense.

    7-2 - Size exchange: Customers based in mainland France have 14 days from the date of delivery to change the size of their product. They must inform ATELIER ST EUSTACHE by email in order to proceed with the exchange, at the following address: violette@ateliersteustache.fr

    Before making the return, the customer must make sure of the good availability of the size which he wants to exchange. If the product is in stock, then Atelier St Eustache will send back the new size, once the return product of the customer received and controlled by the team Atelier St Eustache. If the product is not any more in stock, then Atelier St Eustache will propose the available models in the desired size. If the customer does not wish another model, then it will be refunded.

    Items returned incomplete, damaged, deteriorated, stained or with the label removed by the customer will not be exchanged.

    The risks and costs of return are always at the charge of the customer. We recommend to use the service of followed letter for the return of the product. 

    The shipping costs for the return of the new product to the customer will be charged to ATELIER ST EUSTACHE.

    We invite the customer to return the package by any means providing proof and giving a certain date to its sending (registered mail with acknowledgement of receipt, colissimo followed, followed letter, etc.).

    7-3 - If the return is due to an error on behalf of Atelier St Eustache, the expenses of delivery of the outward journey and return which were paid by the customer will be refunded to him. For this the customer must join in his parcel of return a proof of transport costs to be able to be refunded.

    Once the goods have been received, checked and accepted by our services, the refund of the returned items at the invoiced price will be made by crediting the customer's bank account corresponding to the bank card used for payment, at the latest within 14 days following the receipt of the returned items.

    7-4 - Return policy outside of France.

    The return and exchange costs are at the customer's expense outside France. Outside the EEC, customs duties and taxes, and formalities are at the customer's expense.

    ATTENTION: ITEMS ON SALE OR PROMOTION CANNOT BE REFUNDED OR EXCHANGED

    8 - Intellectual Property

    All the elements of the website www.AtelierStEustache.fr, whether visual, graphic, video or sound, are protected by copyright, trademarks or patents. They are the exclusive property of ATELIER ST EUSTACHE SAS. Consequently, the partial or total reproduction, on any support whatsoever, of the elements composing the site and the catalog, their use as well as their provision of third parties are formally prohibited.

    9 - Responsibility

    The products offered are in conformity with the French legislation in force. ATELIER ST EUSTACHE SAS cannot be held responsible in case of non-respect of the legislation of the country in which the products are delivered. It is the customer's responsibility to check with the local authorities the possibilities of importing or using the products he/she plans to order.

    The photographs and texts reproduced and illustrating the products presented are not contractual. Consequently, the responsibility of ATELIER ST EUSTACHE SAS cannot be engaged in the event of error in one of its photographs or one of its texts.

    ATELIER ST EUSTACHE SAS cannot be held responsible for the non-execution of the contract concluded in case of stock shortage or unavailability of the product, force majeure, total or partial strikes, internal or external to the company, blocking of the means of transport or supply for any reason whatsoever, governmental or legal restrictions, computer breakdowns, blocking of telecommunications including networks and in particular Internet.

    ATELIER ST EUSTACHE SAS will not be held responsible for any indirect damage due to the present, operating loss, loss of profit, damage or expenses.

    Hypertext links may lead to other websites than the www.AtelierStEustache.fr website. ATELIER ST EUSTACHE SAS declines all responsibility in the event that the content of these sites is contrary to the legal and regulatory provisions in force.

    10 - Protection of personal data

    ATELIER ST EUSTACHE SAS undertakes not to divulge to third parties the information you provide. These are confidential. They can be used to personalize the communication and the offer of product reserved to the customers of Atelier St Eustache.

    Consequently, in accordance with the law on data processing and freedom of January 6, 1978, you have the right to access, rectify and oppose personal data concerning you. To do so, simply send us a request online or by mail, indicating your name, first name and address.

    11 - Modification of the general conditions of sale

    ATELIER ST EUSTACHE SAS reserves the right to adapt or modify at any time the present general conditions of sale. The new general conditions of sale will be brought to the attention of the customer by online modification and will be applicable to sales made after the modification.

    12 - Applicable law

    The present general conditions of sale are governed by French law. In case of dispute, only the French courts will be competent.
