General conditions of sale

1 – Preamble

The merchant site www.AtelierStEustache.fr is operated by the company ATELIER ST EUSTACHE SASU with capital of €1,000, having its registered office at 5 rue de Nuits 69004 LYON and registered in the Lyon trade and companies register under number RCS 830 242 368 .

The general conditions of sale detailed below apply to all orders placed with the company ATELIER ST EUSTACHE SAS for all items offered on the site www.AtelierStEustache.fr, unless otherwise agreed in writing.

The conditions of sale applicable to any transaction on the site www.AtelierStEustache.fr are those mentioned online on the said site at the time the order is placed by the customer. The customer acknowledges having read these conditions prior to his order.
Consequently, placing an order on the site www.AtelierStEustache.fr implies full and complete acceptance of these conditions of sale by the customer.

2 – Price

2-1 – Prices are expressed in euros, all taxes included, excluding participation in processing and shipping costs.

2-2 – In the event of an order to a country other than mainland France, the buyer is the importer of the product(s) concerned. For all products shipped outside the European Union and DOM-TOM, customs duties, other local taxes, import duties or state taxes may be payable. These duties and sums are not the responsibility of ATELIER ST EUSTACHE SAS. They will be the responsibility of the buyer and are your sole responsibility both in terms of declarations and payments to the competent authorities and organizations in your country.

2-3 – All orders are payable in Euros.

2-4 – ATELIER ST EUSTACHE SAS reserves the right to modify its prices at any time on its website www.AtelierStEustache.fr. The products are invoiced on the basis of the rates in effect at the time of order registration, subject to availability. The products remain the property of ATELIER ST EUSTACHE SAS until full payment of the price.

3 – Order and Validation

3-1 - Customers of ATELIER ST EUSTACHE SAS must be emancipated minors or have reached the legal age of majority and not be protected within the meaning of Article 488 of the Civil Code. ATELIER ST EUSTACHE SAS reserves the right to refuse an order if the customer in question has a payment default in their order history.

3-2 - These conditions can be viewed on the website www.AtelierStEustache.fr. At the customer's request, they can be sent by email or post.

3-3 - When the customer clicks on the "Place my order" button after the order process, he declares that he accepts it and all of these General Terms and Conditions of Sale fully and without reservation. The data recorded by ATELIER ST EUSTACHE SAS constitutes proof of all transactions made by ATELIER ST EUSTACHE SAS and its customers. The data recorded by the payment system constitutes proof of financial transactions.

3-4 – The Customer is responsible for the accuracy and completeness of the information provided by himself on his Customer account and on his order to ensure its proper processing. ATELIER ST EUSTACHE SAS cannot be held responsible for additional delivery delays or costs. Costs incurred by ATELIER ST EUSTACHE SAS resulting from errors in the information provided by the Customer will be borne by the Customer.

4 – Availability

Our product offers are proposed within the limit of available stocks. In this context, information on the availability of the products is provided to the customer at the time of placing the order. If the items prove to be unavailable after the order, the company ATELIER ST EUSTACHE SAS will inform and invite the customer to cancel or modify his order.

5 – Delivery

ATELIER ST EUSTACHE SAS delivers its Products in France and certain French Overseas Territories, in all countries of the European Union and in the following countries: Hong Kong, Japan, South Korea, Canada, United States, Algeria, Morocco, Tunisia.

The products are shipped to the delivery address indicated by the Customer when ordering. Delivery cannot be made to hotels or PO boxes. The delivery times indicated on the site are indicative times, corresponding to the average processing and delivery times. In order for these times to be respected, the Customer must ensure that they have provided accurate and complete information concerning the delivery address (such as, in particular: street number, building number, staircase number, access codes, names and/or intercom numbers, etc.). If the delivery information is incorrect, Atelier St Eustache disclaims any liability in the event of non-delivery. In the event of the package being returned due to incorrect address, the products will be refunded and the order must be placed again.

In the event of a delivery delay of more than 15 working days, if the product has not been shipped, the Customer may cancel the order by registered letter with acknowledgement of receipt and request a refund of the order.
If the item has been shipped before receipt of the cancellation of the order due to a delivery delay of more than 15 days, ATELIER ST EUSTACHE SAS will refund the item and the shipping and return costs, upon receipt of the item, complete, in its original condition and with all labels.

ATELIER ST EUSTACHE SAS undertakes to inform the Customer of the progress of the processing of their order.

In the event of damaged packages (already opened, missing products, etc.), the Customer undertakes to notify the carrier and ATELIER ST EUSTACHE SAS, by any means, of any reservations within 3 days of receipt of the product.

ATELIER ST EUSTACHE SAS cannot be held responsible for the consequences due to a delay in delivery that is not its fault.

6 – Payment

Payment of the full price is made when ordering. It is made by bank card (Visa, MasterCard, Carte Bleue Nationale and international) and credit card (American Express)

The company ATELIER ST EUSTACHE SAS implements all necessary means to ensure the security and confidentiality of data transmitted online.

7 – Return policy and after-sales service

7-1 – In accordance with articles L 121-16 of the Consumer Code, the customer benefits from a reflection period of 15 days from delivery to return the item(s) ordered without having to pay penalties except for the return costs which will remain his responsibility. The items must be returned in their original packaging, labeled, complete, new, unworn, unwashed.

For health reasons, we cannot resell a product that has been in contact with the foot. Any sock tried on cannot be returned.

    Items returned incomplete, damaged, deteriorated, stained by the customer or with the rider unstitched will not be refunded.

    The risks and costs of return are always the responsibility of the customer.

    7-2 – Size exchange: The customer based in metropolitan France has a period of 14 days from the day of delivery if he wishes to change the size of his product. He must inform ATELIER ST EUSTACHE by email in order to proceed with the exchange, at the following address: violette@ateliersteustache.fr

    Before making the return, the customer must ensure the availability of the size they want to exchange. If the product is in stock, then Atelier St Eustache will send the new size, once the customer's product return has been received and checked by the Atelier St Eustache team. If the product is no longer in stock, then Atelier St Eustache will offer the models available in the desired size. If the customer does not want another model, then they will be refunded.

    Items returned incomplete, damaged, deteriorated, stained or with the label removed by the customer will not be exchanged.

    The risks and costs of return are always the responsibility of the customer. We recommend using the tracked letter service for returning the product.

    The shipping costs for returning the new product to the customer will be borne by ATELIER ST EUSTACHE.

    We invite the customer to return the package by any means providing proof and giving a certain date of its sending (registered letter with acknowledgment of receipt, tracked Colissimo, tracked letter, etc.).

    7-3 – If the return is due to an error on the part of Atelier St Eustache, the outward and return delivery costs that were paid by the customer will be refunded. For this, the customer must include proof of transport costs in their return package in order to be reimbursed.

    Once the goods have been received, checked and accepted by our services, the reimbursement of the returned items at the invoiced price will be made by credit to the customer's bank account corresponding to the bank card used for payment no later than 14 days following receipt of the returned items.

    7-4  Return policy outside Metropolitan France.

    Return and exchange costs are at the customer's expense outside France. Outside the EEC, customs duties and taxes, and administrative costs are the responsibility of the customer.

    8 – Intellectual property

    All elements of the site www.AtelierStEustache.fr whether visual, graphic, video or sound, are protected by copyright, trademarks or patents. They are the exclusive property of ATELIER ST EUSTACHE SAS. Consequently, the partial or total reproduction, on any medium whatsoever, of the elements composing the site and the catalog, their use as well as their provision to third parties are formally prohibited.

    9 – Responsibility

    The products offered comply with current French legislation. ATELIER ST EUSTACHE SAS cannot be held liable for non-compliance with the legislation of the country in which the products are delivered. It is the customer's responsibility to check with the local authorities the possibilities of importing or using the products they plan to order.

    The photographs and texts reproduced and illustrating the products presented are not contractual. Consequently, ATELIER ST EUSTACHE SAS cannot be held liable in the event of an error in one of its photographs or texts.

    ATELIER ST EUSTACHE SAS cannot be held responsible for the non-performance of the contract concluded in the event of stock shortage or unavailability of the product, force majeure, total or partial strikes, internal or external to the company, blocking of means of transport or supply for any reason whatsoever, governmental or legal restrictions, computer breakdowns, blocking of telecommunications including networks and in particular the Internet.

    ATELIER ST EUSTACHE SAS will not incur any liability for any indirect damages arising from this, loss of business, loss of profit, damages or costs.

    12 – Applicable law

    These general terms and conditions of sale are governed by French law. In the event of a dispute, only the French courts will have jurisdiction.
